WORK SESSION MINUTES

TOWN COUNCIL                                                 MONDAY, NOVEMBER 17, 2008
COUNCIL CHAMBERS                                                               TIME:  7:00 P.M.


1.      Call Meeting to Order

Mayor Prague called the meeting to order at 7:00 p.m.

2.      Roll Call

Members Present:        Mayor Cary Prague
        Deputy Mayor Bazzano
        Councillor Kathryn Hale
        Councillor Lisa Maneeley
        Councillor Kevin McCann 
        Councillor Paul Oates
        Councillor John Pelkey
        Councillor Keith Yagaloff

Also Present:           Matthew Galligan, Town Manager
                                Duncan Forsyth, Town Attorney

3.      Public Participation

Mr. Bart Pacekonis of 39 Blue Ridge Drive came before the Council to inform the Council and public that there was a raccoon acting eratical near his home.  This item was not in the police bulletin and he felt it was necessary to inform the public of this incident to ensure the public’s safety and knowledge.

Mr. John Woodcock, 395 Buckland Road came before the Town Council.  He explained that he had written a letter addressed to Mr. Matthew Galligan and he read that letter into the record.  Mr. Woodcock then reviewed events that have happened regarding 765 Sullivan Avenue and stated that if there is not a signed contract with Mr. Galligan, this issue will go to court to have a Judge order Mr. Galligan to sign the contract.

Chief Philip Crombie, Fire Department came forward to invite the Town Council members to the Fire Headquarters on Sunday, November 23, 2008 for a dedication for the new fire ladder truck.

Mr. Jim Yungk of Farnham Road came before the Council to explain that there have not been signed erected on Troy Road and there are still a lot of trucks using the road.  Mayor Prague stated that he has a call into the Police and they have not responded to him yet.

4.      Communications

Councillor Hale made a motion to recess the Work Session at 7:14 p.m. for twenty (20) minutes to enable Council members to review materials that were received.  Councillor Pelkey seconded the motion; and it was approved, unanimously.

Councillor Yagaloff stated for the record that after having an agenda meeting on November 13, 2008 and spending 2 ½ hours on the agenda, the agenda was changed.  There were specific resolutions that Town Attorney Forsyth felt the Town Council should proceed with caution on and his concerns were also ignored.

Mayor Prague made a motion to recess the Work Session.  Councillor McCann seconded the motion, it passed on a Roll Call vote of 5 to 3 with the dissenting votes being cast by Councillors Hale, Pelkey, and Yagaloff.

6.      Items for Discussion

        None

7.      Executive Session

Deputy Mayor Bazzano made a motion to go into Executive Session at 7:52 p.m. to discussion potential litigation regarding 765 Sullivan Avenue.  Councillor Maneeley seconded the motion and if failed on a Roll Call vote of 5-3 with the dissenting votes being cast by Councillors Hale, Pelkey, and Yagaloff, (this motion needs a 2/3rd’s vote by the Council to pass).

8.     Adjournment

At 7:55 p.m. Councillor McCann made a motion to adjourn the Work Session.  Councillor Bazzano seconded the motion and it was approved, unanimously.
